In today’s Q&A we have Flavio Peter, our International Arbitration expert in Switzerland.
Flavio Peter is a partner with Peter & Kim in Zurich specializing in international and domestic arbitration and related litigation proceedings, including enforcement and attachment proceedings before local courts and setting aside proceedings before the Swiss Federal Supreme Court. Flavio primarily acts as party representative in disputes arising under construction contracts, international sales contracts, disputes concerning long term gas supply contracts, but also agency and distribution agreements, joint venture contracts, and post-M&A disputes.
[music] >> My name is Flavio Peter and I’m a partner with Peter and Kim in the Zurich office. Peter and Kim is a global arbitration boutique which has offices in Geneva, Zurich, Seoul, Singapore, Sydney and Perth. And as such boutique we specialize in international commercial arbitration, investment arbitration and sports arbitration.
We have been a top 30 ranked global arbitration firm for several consecutive years. So we can compete with all the big players in the market. But we are much more nimble and dynamic and from a partner’s perspective hands-on.
Globally we represent clients in both civil law and common law jurisdictions in more than a dozen of different languages. So we know we have a unique setup that bridges Europe and Asia Pacific very competitive offerings. So we are quite strong in the construction sector as well as in the energy oil and gas sector. So such our typical client structure would be large multinational industrial players, so large groups of companies etc.
But of course we also have a strong trading or international sales and post M&A practice and that often comes with SMEs as clients. And last but not least particularly when you think of sports arbitration but also shareholder disputes or investment arbitration we also represent private persons, so the investors in in those type of situations.
So, there’s a a bouquet of different client structures, but of course the the focus would be on large industries. Of course, I count managing the Zurich office for Peter and Kim as a personal achievement, and I’m proud that we have such a great team together.
Also from a personal and professional perspective, I’m happy that I got to do my LLM at UC Berkeley, where I met wonderful people from all around the world at the time when the US political climate was a bit more attractive. Now, in terms of cases, most of it is confidential. I cannot spell that much information, but one landmark case that is publicly known is when we successfully represented OMV against Gazprom Export in two parallel arbitrations in relation to a dispute arising out of curtailment of gas supplies that
occurred in 2022 and 2023. I joined Global Law Experts out of curiosity. I had heard of it, and I wanted to find out what it was all about, and hence I’m here and doing exactly that.
