Since 2010, the Global Law Experts annual awards have been celebrating excellence, innovation and performance across the legal communities from around the world.
This Global Law Experts Round Table brought together dispute resolution practitioners from Switzerland, Indonesia and Nigeria to examine the practical realities of managing cross-border commercial disputes in 2026. The discussion began with the early decisions that shape a party’s position, including how clients approach the choice of forum and governing law, and the factors that tip the balance between litigation, arbitration and other mechanisms.
The panel then followed a dispute through its key stages: the procedural challenges of gathering evidence and preparing for a hearing, particularly where evidence or witnesses are located abroad; the accessibility and reliability of interim relief such as injunctions and freezing orders, and the risks of moving too slowly or choosing the wrong forum; and the obstacles to enforcing foreign judgments and arbitral awards. Speakers also looked ahead to how artificial intelligence, digital evidence, geopolitical shifts and evolving institutional rules may reshape dispute resolution over the next three to five years.
