Greece FAQ's

In Greece, lawyers provide legal advice, represent clients in court, and handle negotiations. Notaries public (Συμβολαιογράφοι) are independent officials responsible for drafting, authenticating, and registering official documents such as contracts and property deeds. While lawyers advocate for clients, notaries act impartially to ensure the legality and authenticity of documents, playing a crucial role in property transactions and other formal agreements.

Buying property in Greece involves signing a preliminary agreement, followed by due diligence to check the property’s status. The transaction completes with the signing of a final contract before a notary public, who authenticates the deed. The buyer then registers the property with the Land Registry and pays applicable taxes. Legal advice is recommended throughout to ensure compliance with Greek property laws and protect the buyer’s interests.

After a divorce in Greece, child custody arrangements prioritize the child’s best interests. Parents may agree on custody terms or seek court intervention if they disagree. Courts typically favor shared parental responsibility, but may grant sole custody to one parent depending on circumstances. The Greek legal system aims to ensure that the child maintains a stable and supportive environment after divorce.

Inheritance in Greece follows strict statutory rules, reserving a portion of the estate for close relatives even if a will exists. Wills must be handwritten or notarized to be valid. If no will is present, the estate is distributed according to Greek inheritance laws. It is advisable to seek legal advice when drafting wills or managing inheritance to ensure compliance and protect beneficiaries’ rights.

Yes, foreigners can buy property in Greece. EU citizens face no restrictions, while non-EU buyers need special permission only in sensitive border zones. All buyers must obtain a Greek tax number (AFM) and usually open a local bank account. Due to past registry issues, Global Law Experts advise working with a local lawyer to ensure title checks, contracts, and notarial procedures are handled properly.

Within Greece, employment termination rules are designed to protect workers from unfair dismissal. Employers must have a valid reason, such as financial difficulties or employee misconduct, before ending a contract. They’re also required to follow legal obligations on notice periods and severance pay. If an employee believes a dismissal was wrongful, they can take their case to the labour courts, where it will be reviewed to ensure fairness and adherence to Greek employment laws governing the region.

A Greek tax number, known as AFM (Arithmos Forologikou Mitroou), is a unique identification number issued by the tax office to individuals and businesses. Foreigners must obtain an AFM to buy property in Greece, as it is required for signing contracts, paying property taxes, opening a bank account, and registering the purchase with authorities. It is the first legal step in any property transaction.

A foreigner can start a business in Greece by obtaining a Greek tax number (AFM), registering with the General Commercial Registry (GEMI), choosing a legal structure such as a sole proprietorship or limited liability company, opening a Greek bank account, and fulfilling social security and tax obligations. Depending on nationality, a residence or work permit may also be required for lawful operation.
