A judgment awards a business AED 600,000, but its finance director cannot enter the amount as cash received. The debtor may pay voluntarily. It may challenge the decision, dispute a calculation or hold assets that are difficult to reach. The court’s determination and the route to recovery are connected, yet each requires its own work.
This article uses domestic UAE civil money judgments as its focus. It does not address recognition of foreign judgments, arbitral awards or the separate procedures of every specialist jurisdiction. A lawyer in Dubai reviewing the position should first identify the court and procedural regime involved, then explain what can lawfully happen next.
The central planning question is concrete: which part of the judgment can be pursued now, against whom and through what available process?
The operative part of the judgment should be read alongside the reasoning and any later decision affecting it. A party may have requested several remedies and received only some of them. The execution plan must follow the relief ordered, including the parties against whom it was granted.
Consider a hypothetical claim involving a trading company and its manager. The creditor obtains a money award against the company, while the claim against the manager is dismissed. The company’s liability cannot simply be treated as the manager’s personal debt because the creditor believes the manager caused the problem.
A lawyer in Dubai should identify the principal sum, any awarded additions and the relevant calculation basis. Amounts paid before or after judgment require accurate treatment. A separate expense incurred by the creditor does not become part of the executable award merely because it relates to the dispute. Any proposed calculation should be traceable to the judgment and applicable legal basis.
An enforcement assessment needs the status of the particular judgment, not a general statement that the case was won. Determine whether an appeal remains available, whether one has been filed and whether expedited enforcement applies. Identify any relevant stay or later order.
Article 214 of the UAE Civil Procedure Code distinguishes judgments open to appeal from judgments having expedited effect under law or the judgment. Article 177 treats cassation and stays separately, including specified exceptions. These provisions are reasons to check the actual procedural position rather than assume that every challenge stops enforcement or that none does.
Ask the adviser to state the practical consequence in writing. A useful explanation identifies the relief currently available and the event that may change that position. It should also explain which issue needs a decision from the court. A pending application is not interchangeable with an order granting the requested protection.
The Civil Procedure Code sets out the recognised execution writs and the requirements for compulsory execution. These include a right that is established, ascertainable in amount and due. The appropriate execution copy and relevant court requirements must be checked in the individual matter.
A lawyer in Dubai can examine whether the intended request corresponds with the available writ. If the parties have since entered a settlement, the relationship between that settlement and the judgment needs review. A new payment arrangement may affect the outstanding amount or the timing of agreed action.
Service and procedural steps also matter. They should be assessed against the current rules and court record. A creditor should not rely on an informal message saying that the debtor knows about the judgment as a substitute for the required procedural assessment. This article deliberately gives no universal timetable: the nature of the judgment and current procedural position have to be established first.
The judgment establishes the rights it decides. Recovery also depends on whether money or property is available through a lawful process. An economically valuable business may have assets subject to other rights, receivables that are contested or operations conducted by a different legal entity.
For a hypothetical illustration, a debtor company occupies impressive premises and uses expensive machinery. The premises may be leased. The machinery may belong to a financing company. The company’s customers may owe it money, but those amounts may not yet be due. Visible activity provides leads for lawful investigation; it does not establish ownership or a recoverable balance.
Lawyers in Dubai should distinguish known assets from assumptions. Useful leads have a basis that can be checked. A registered asset, identified debtor or documented payment relationship raises more specific questions than the statement that the company seems wealthy. The adviser can assess what requests are available and what evidence they require.
Enforcement measures should be connected with the recovery objective and the legal requirements. A proposed request needs an explanation of what it is intended to locate, preserve or realise. The availability of any measure depends on the facts, law and court’s decision.
For example, an identified receivable may justify examining an appropriate route directed at funds owed to the judgment debtor. The legal status of that receivable and the rights of the person holding it require analysis. The creditor cannot assume that any money passing through an associated business belongs to the debtor.
A lawyer in Dubai should also explain alternatives if a request is rejected or produces no funds. Repeatedly submitting the same request without addressing the reason for refusal can consume resources without changing the result. The response may call for better evidence, a different lawful measure or recognition that the expected asset is unavailable.
Enforcement involves calculations that can change. Record each payment with its date, source, amount and allocation. Reconcile money actually received with sums deposited or earmarked through a court process. These may be different stages of recovery.
If several proceedings or creditors are involved, avoid assuming that a sum appearing in one file can immediately be paid to the applicant. The existence of attachments, competing rights or court directions may affect distribution. Ask for the basis of the relevant position and the next event required for release.
Partial payments also need to be reflected in subsequent requests. A consistent ledger protects the creditor from demanding an amount already satisfied and makes an incorrect debtor calculation easier to challenge. Where an awarded addition changes over time, obtain a checked calculation rather than copying the original claim figure into every application.
An execution dispute requires an assessment of its substance and procedural route. The debtor may contend that payment has been made, that the requested amount exceeds the award or that a measure affects property belonging to someone else. Those allegations should be checked against the record.
A lawyer in Dubai can distinguish an issue requiring clarification of the enforcement position from an attempt to repeat arguments about the underlying merits. The appropriate response depends on what has actually been raised and the rules governing it. There should be no assumption that an objection automatically proves misconduct or gives the debtor a fresh opportunity to contest every finding.
The creditor should ask whether execution can continue, whether a stay exists and what is required to address the disputed point. Each answer should refer to the relevant application or order. A general update saying that the other side has objected leaves the client unable to understand the effect on recovery.
A judgment debtor may offer payment by stages. The creditor should compare that proposal with the evidence of assets and available enforcement options. A shorter guaranteed payment is not the same proposition as a longer promise dependent on uncertain trading income.
Assess what happens to current measures if the proposal is accepted, whether security is appropriate and which rights are preserved until performance. The agreement should explain the outstanding balance and how missed payments will be handled. Any change to court proceedings should be coordinated with the terms, rather than treated as a separate administrative favour.
A place on a list of the best lawyers in Dubai tells a creditor little about whether a particular asset can be reached. That question needs a recovery analysis grounded in the judgment and available evidence. An unidentified asset remains an unresolved issue, however strong the creditor’s claim may be.
Useful reporting separates an application made, an order issued, a measure implemented and money received. Each is progress, but they are different outcomes. A report should identify which stage has been reached and what dependency remains.
Lawyers in Dubai can make the next decision easier by explaining what new information would justify changing the plan. Confirmation of an asset, a rejection based on a remediable omission or a credible payment offer may each warrant a different response. The client should understand the purpose of continuing activity and the basis for expectations.
