VASS Lawyers obtains the recess of a public procurement contract execution for road modernisation

The Court of Appeal Bacau upheld the complaint filed by VASS Lawyers, acting as representative of Gironap Prod S.A., a leading construction company in Romania, concerning the public procurement procedure for the awarding of the contract “Modernization of local roads, Berzunţi Village, Bacau County”.

Therefore, the court ruled to amend the decision of the National Council for Solving Complaints no. 464/48C10/296, admitting the appeal made by Gironap Prod S.A. against the result of the procedure and compelled Berzunţi Village to reevaluate the submitted tenders. The Court of Appeal Bacau also rejected the request for intervention submitted by the successful bidder and ordered suspension of the contract concluded between the successful bidder and the contracting authority.

The court’s decision is even more important in this case as the contracting authority proceeded to the conclusion of the contract, despite the fact that the result of the procedure had been contested to the National Council for Solving Complaints (CNSC).
