New Federal Labor Law Prioritises Worker Well-being with “Chair Law”

A significant milestone in labor law was achieved yesterday with the publication in the Official Gazette of the Federation of an amendment to the Federal Labor Law, commonly known as the “Chair Law.” This new legislation represents a substantial advancement in the protection of the health and well-being of Mexican workers, guaranteeing their right to rest during the workday.

Key Provisions of the Reform:

  • Obligation to Provide Seating: Employers in the service, commerce, and similar sectors are required to provide seats or chairs with backrests for their workers, both for the performance of their duties and for periodic rest during the workday.
  • Prohibition of Standing: Employers are prohibited from requiring workers to stand for the entire workday.
  • Rest Areas: In cases where it is not possible to provide seating for work tasks, employers must designate specific areas for workers to take periodic breaks.
  • Update of Internal Regulations: Internal labor regulations must be updated to include mandatory rest periods and rules for the proper use of seating during the workday.
  • Implementation Deadlines: The reform will enter into force within 180 calendar days, while internal regulations must be adjusted within an additional 180 days.

Implications of the Reform:

  • Economic Implications: The implementation of this law may generate some initial investments for companies to acquire the necessary furniture and adapt their workspaces. However, in the long term, a reduction in costs associated with work-related illnesses caused by prolonged standing, such as musculoskeletal problems and chronic fatigue, is expected.
  • Legal Implications: Companies must ensure compliance with the new provisions of the law, which involves modifying their collective bargaining agreements, internal regulations, and labor practices. Failure to comply with this law could result in administrative and labor sanctions.
  • Implications for Worker Satisfaction: By guaranteeing better working conditions and greater respect for their rights, this reform could contribute to increased job satisfaction, improved organizational climate, and reduced turnover.

Recommendations: Companies are advised to begin updating their Internal Labor Regulations in anticipation of the publication of specific standards on occupational hazards associated with standing work by the Ministry of Labor and Social Welfare.
