Ghana FAQ's

While not every legal procedure in Ghana requires a lawyer, their involvement is highly recommended in complex or formal matters to ensure rights are protected. For simple processes, individuals might proceed independently, but for transactions like property transfers, litigation, or drafting contracts, qualified legal advice helps prevent errors and legal disputes, providing clarity and confidence throughout the process.

To legally acquire land in Ghana, a buyer must obtain due diligence reports verifying ownership and the absence of disputes. The transaction requires a formal sale agreement, followed by registration with the Lands Commission. Involvement of a qualified lawyer is essential to navigate customary and statutory land tenure systems, ensuring the purchase complies with all legal requirements and protects the buyer’s interests.

Divorce in Ghana can be granted through mutual consent or on grounds such as adultery, cruelty, or separation. The process requires filing in a family or at a circuit court, depending on religious or customary backgrounds. Negotiations over child custody, maintenance, and property division accompany proceedings, with courts aiming to balance fairness and protection of vulnerable parties within Ghana’s legal framework.

In Ghana, common business entities include sole proprietorships, partnerships, private limited companies (Ltd), and public limited companies (PLC). Each type has unique registration, management, and liability regulations governed by the Registrar General’s Department. Choosing the right entity depends on factors such as business size, ownership structure, and liability considerations, all essential for compliant and efficient operation.

Ghanaian law regulates employment termination through fair grounds like misconduct, redundancy, or incapacity. Employers must provide adequate notice or severance pay as stipulated in contracts or labor laws. Unfair dismissal claims can be brought before the National Labour Commission for resolution, ensuring employee rights are protected while balancing employer interests within Ghana’s labor framework.

Foreigners cannot own land outright in Ghana—instead, they may acquire leasehold interests up to 50 years, renewable upon expiry. While buildings and structures on the land can be fully owned, the land itself remains under lease. Foreigners must perform diligent title checks, lease registration at the Lands Commission, and often engage local counsel to navigate customary, stool, or state land systems.

In Ghana, freehold property means the owner has indefinite rights over the land, but since 1992 foreigners are prohibited from acquiring freehold land. Leasehold property, on the other hand, grants ownership rights for a fixed term—typically 99 years for Ghanaians and up to 50 years for foreigners—after which the lease must be renewed with the landowner or customary authority.

In Ghana, property division after divorce follows the principle of equitable distribution, meaning assets are shared fairly, not necessarily equally. Courts consider contributions by both spouses, including non-financial roles like childcare and homemaking. The 2007 Supreme Court case Mensah v. Mensah established that both partners are entitled to a fair share of marital property.
