The EU Law Practice is a complex legal field dedicated to advising clients on the body of treaties, regulations, and directives that govern the European Union. This practice is unique as it deals with a supranational legal system that takes precedence over the national laws of its member states in many areas. It covers a vast range of subjects, including EU competition and antitrust law, the rules of the EU Single Market regarding the free movement of goods, services, capital, and people, and sector-specific regulations. A significant component of the practice is advising on compliance with landmark EU legislation that has a global reach, such as the General Data Protection Regulation (GDPR). Practitioners represent clients in matters before EU institutions, including the European Commission and the Court of Justice of the European Union.
European Union law is a unique, autonomous legal system that operates alongside the national laws of the EU’s member states. It is derived from two main sources: primary law, which consists of the founding treaties of the EU, and secondary law, which includes regulations and directives passed by EU institutions. In the areas where the EU has been granted authority by its members, EU law is superior to the national laws of the member countries, creating a common legal framework across the continent.
The EU Single Market is a unified economic area comprising all member states of the European Union, designed to function as a single domestic market. It works by guaranteeing the “four freedoms”: the free movement of goods, services, capital, and people across the internal borders of the EU. This is achieved by eliminating customs duties and harmonizing national regulations, which allows businesses to operate more easily and efficiently across the entire bloc and gives consumers a wider choice of products.
The General Data Protection Regulation (GDPR) is a comprehensive and stringent data privacy and security law that establishes the rights of individuals regarding their personal data. It applies to any organization that processes the personal data of individuals residing in the European Union, regardless of the company’s own location. Therefore, a non-EU company must comply with the GDPR if it offers goods or services to, or monitors the behavior of, individuals within the EU, making it a regulation with significant global reach.
For a non-EU business to sell products in the European Union, it must meet several key legal requirements. First, its products must comply with the EU’s strict health, safety, and environmental standards, often proven by affixing a CE marking. The company must also handle all customs procedures, including paying the correct import tariffs and Value-Added Tax (VAT). Finally, if the business collects any personal data from customers within the EU, it is legally required to be fully compliant with the GDPR.
