Anti-dumping law prevents foreign producers from selling goods below fair market value to undercut domestic industries. Governments impose duties or tariffs on such imports after investigations confirm dumping and resulting injury to local businesses. These laws protect fair trade and ensure a level playing field in global markets.

In trade law, “dumping” occurs when a foreign company sells goods in another country at a price lower than their normal value—often below production cost or domestic market price. This practice can harm local industries, prompting anti-dumping investigations and potential duties to restore fair competition.

An anti-dumping duty is imposed after a government investigation—usually by a trade authority—confirms that imported goods are sold below fair market value and cause material injury to a domestic industry. If proven, a duty or tariff is levied on those imports to offset the price difference and protect local producers.

In the U.S., anti-dumping laws are enforced by the Department of Commerce (DOC) and the U.S. International Trade Commission (USITC). The DOC investigates whether dumping has occurred, while the USITC determines if it causes material injury to a U.S. industry. If both find violations, anti-dumping duties are imposed and enforced by U.S. Customs and Border Protection (CBP).
