Granting a power of attorney is often the easiest way to keep affairs running when you can’t act yourself. Travel, illness, or business abroad can make it impossible to sign documents or manage accounts directly, and handing that role to someone trusted solves the problem. The same step, though, carries risk. A power of attorney gives broad authority, and if it’s drafted too loosely or placed in the wrong hands it can be misused.
When assets, property, or businesses are spread across more than one country, the scope for problems only grows. Choosing the right attorney, limiting their powers, and adding checks into the document all make a difference to how secure it will be.

Abuse often comes from powers that are drawn too wide. Many people rely on standard templates that give an attorney authority to act “in all matters,” which might sound convenient but leaves no real limit on what they can do. That wording can let someone move money, sell property, or sign contracts that were never meant to be part of the arrangement.
A better way is to keep the powers tied to the need at hand. If the aim is to let someone manage a single account while the principal is abroad, name the bank and the account, and set out what transactions are allowed. For a property sale, link the authority to that specific asset and that deal. Where ongoing support is needed, such as in a company, the document can focus on the role in that business rather than giving reach over personal wealth.
The safeguards only work if the right person is in place. Many people default to naming the eldest child or a close relative because it feels natural, but that can backfire if the person lives abroad, is busy with their own affairs, or isn’t confident with money.
The role needs someone who is steady, available, and able to handle financial and legal decisions. That means more than trust alone. The attorney should be comfortable dealing with banks, lawyers, and advisers, and willing to keep records of what they’ve done. Where no single person is a good fit, the role can be shared. One attorney might handle property while another oversees accounts, or two might be required to sign together before major assets are sold. Splitting duties in this way adds practical balance and reduces the scope for mistakes or abuse.
Even with a trusted attorney, it helps to build checks into the document itself. One way is to make large transactions, such as property sales or high-value transfers, conditional on two signatures. Another is to divide tasks, with one attorney handling banking and another taking care of property or investments. Both approaches slow things down a little but stop one person acting alone.
Regular reporting is another safeguard. Some documents require the attorney to provide account statements or updates at set times, which gives a clear record of what has been done. In larger estates or business structures, families often ask a professional adviser to review accounts or confirm that key steps follow the agreed plan.
For those with assets in more than one country, adding an independent co-attorney or supervisor can keep the arrangement balanced and recognised across jurisdictions.
A power of attorney doesn’t have to run without end. It can be set to finish after a defined period, for example once a property deal is complete or when the principal returns from an overseas posting. That way the authority closes when the original need has passed.
Some are written to activate only if the principal becomes incapacitated. These “springing” powers stay inactive until a doctor confirms the person can’t manage their own affairs. They give reassurance that support will be there in an emergency without handing control over too soon.
Conditions can also narrow how powers are used. A sale might only be allowed above a stated price, or certain medical decisions may need written confirmation from a specialist. These limits make the attorney’s role clear and reduce the chance of authority being stretched beyond what was intended.
A power of attorney shouldn’t sit in isolation. If it’s drafted without reference to wills, trusts, or family agreements, the attorney may be given authority that cuts across what those documents say. An attorney with broad powers over shares, for instance, could take steps that conflict with a shareholder agreement or a foundation deed. That creates uncertainty and can even spark disputes.
When the document is tied into the wider plan, the boundaries are clearer. The attorney’s powers can be framed to respect the terms of a trust, support the succession plan in a will, or reflect rules set out in a family charter. For international clients this joined-up approach is especially important, as different countries treat recognition and enforcement in different ways. Drafting with all the pieces in mind keeps the structure consistent and avoids gaps that leave room for misuse.
