How to Use the AIAC Fast Track Procedure in Malaysia (2026): Eligibility, Timelines, Costs and Practical Steps

By Global Law Experts
– posted 4 weeks ago

The AIAC Fast Track framework has been updated in 2026, driven by the current AIAC Arbitration Rules 2026. From 1 January 2o26 onwards, any reference to the previous AIAC Fast Track Arbitration Rules shall be taken as a reference to the Fast Track Procedure in the 2026 Rules. This is a brief guide to how the same applies and how it can be used.

Eligible disputes are typically lower-to-medium complexity claims where parties have either agreed to expedited treatment or the claim falls within the relevant value threshold set out in the applicable AIAC Rules. Expect a compressed resolution window once the tribunal is constituted, with total costs often lower than an ordinary reference but with higher per-calendar-day rates. File your request for expedited treatment at the outset, quantify the claim precisely, and propose a focused timetable. Always confirm the current thresholds, timelines and fees against the AIAC’s published rules and fee schedule before filing.

1. Overview, What Is the AIAC Fast Track Procedure?

The AIAC fast track procedure is a pathway administered by the Asian International Arbitration Centre (AIAC) that compresses the standard arbitral process into a tightly managed timetable culminating in a final, binding award.

Purpose and typical use-cases

The expedited mechanism exists to serve disputes where speed and cost-efficiency matter more than exhaustive procedural latitude. Typical candidates include commercial debt claims, straightforward breach-of-contract disputes, sums due under supply or service agreements, and disputes with a clear documentary trail. Because the timetable is short, the procedure rewards parties who can present a clean, quantified claim supported by core documents rather than sprawling factual narratives.

When can it be triggered

A Party may submit a request to the AIAC for the operation of the Fast Track Procedure (called a “Fast Track Request”), at the time of initiation of arbitration or any time prior to the constitution of the Arbitral Tribunal .

2. Eligibility for the AIAC Fast Track Procedure in Malaysia

It applies where one or more of the following are present:-

(a) the Parties have agreed to adopt the Fast Track Procedure, or any edition of the AIAC Fast Track Arbitration Rules;

(b) the amount in dispute, as described in the notice of arbitration, is quantified at less than USD3,000,000.00 for international arbitration or less than RM2,000,000.00 for domestic arbitration; or

(c) there is exceptional urgency.

To paraphrase, the procedure applies for :

  • Lower-value commercial claims. Where the sum in dispute falls within the AIAC value threshold, the expedited route may apply on request, making it the default proportionate mechanism.
  • Urgent contract disputes. Time-sensitive disputes, for example.
  • Party-agreed expedited references. Where the contract contains an expedited clause, or the parties agree after a dispute arises, the expedited procedure applies by consent regardless of value.

For claims premised on value or urgency, the Fast Track Request shall be considered by the President of the AIAC Court.

When parties can opt out or waive expedited rules

The expedited procedure is not immovable, and may be terminated where a Party so requests or where there is repeated non-compliance of the Fast Track Procedure in the arbitration. The Arbitral Tribunal may then do so after consulting the Parties and the Registrar.

3. How is it done?

It is conducted by a single Arbitrator by way of documents only arbitration, unless otherwise agreed. The award is to be rendered within 6 months of the constitution of the Tribunal.

4. Tactical Tips, Common Pitfalls and a Drafting Checklist

Success in fast track arbitration is largely a function of preparation and discipline. The following practitioner tips reflect current practice.

  • Quantify the claim precisely. A clearly calculated sum, supported by invoices or contract terms, both demonstrates suitability and accelerates the tribunal’s assessment.
  • Bundle core documents early. Prepare a condensed, indexed bundle before filing so that the record is hearing-ready from day one.
  • Propose a focused timetable. Filing a realistic proposed schedule with the request signals seriousness and helps the registry confirm the route quickly.
  • Present the evidence clearly. Make the pleaded claim and the documentary evidence clear and complete with the witness statements clearly drafted with minimal rhetoric and limited areas of factual or technical disputes.

Common pitfalls to avoid:

  • Failing to quantify the claim, which undermines eligibility and invites reversion to the ordinary track.
  • Overcomplicating the evidence by producing volumes of marginal documents.
  • Missing AIAC procedural requirements, such as an incomplete request or absent proof of value.
  • Neglecting interim relief strategy, where an emergency arbitrator or court order should have been sought before the tribunal was constituted.

Sample fast track arbitration clause

Variant A, mandatory expedited below a value cap: “Any dispute where the amount in dispute does not exceed RM [•] shall be finally resolved by arbitration conducted in accordance with the Fast Track Procedure of the AIAC Arbitration Rules”

Variant B, optional expedited on agreement: “The parties may agree in writing that any dispute be resolved by arbitration conducted in accordance with the Fast Track Procedure of the AIAC Arbitration Rules. In the absence of agreement, the ordinary AIAC procedure shall apply.” All clause language should be reviewed for the specific transaction and seat.

Checklist before filing

  • Confirm the arbitration clause names AIAC and check for any fast track wording.
  • Verify the claim value against the applicable threshold under the current AIAC Rules.
  • Prepare a condensed Statement of Claim and an indexed core bundle.
  • Draft the express request for fast track treatment with stated grounds.
  • Attach proof of value, the contract, and a proposed timetable.
  • Assess whether emergency or interim relief is needed before tribunal constitution.

FAQs

What is the AIAC expedited procedure and who can use it?
It is a fast-track process under the applicable AIAC Rules available for eligible disputes, those within the value threshold, subject to party agreement, or demonstrably urgent. Claimants request it at the point of filing the Notice of Arbitration.
Most references resolve in a matter of months from constitution of the tribunal, far faster than the ordinary procedure. The binding award period is that fixed by the applicable AIAC Rules and tribunal directions; complexity, witness requirements and the parties’ conduct can extend the window.
Expedited references generally reduce total cost because of the compressed timetable and limited document production, though the intensity of work can raise effective daily rates. AIAC administrative and arbitrator fees are calculated by reference to the sum in dispute, always confirm figures against the current AIAC fee schedule.
File the Notice of Arbitration with an express request for expedited treatment, state the grounds, and attach a condensed Statement of Claim and core documents. Tribunals expect focused, quantified evidence and calibrated witness statements rather than exhaustive documentary production.
In appropriate cases parties may agree to proceed under the ordinary procedure. Separately, the AIAC or the tribunal may direct that the reference proceed on the ordinary track where the case complexity justifies it.
The Amendment came into operation on 1 January 2026 and amends the Arbitration Act 2005, the framework relevant to expedited pathways and enforcement. The precise statutory text and commencement details should be checked against the gazetted Act on the AGC Laws of Malaysia portal.
No. The tribunal may determine the dispute on documents alone where appropriate, but parties should be prepared for a short, intensive hearing if one is directed.
Include a clear value cap in the clause, limit document production, require concise submissions, set a maximum hearing length, and propose a realistic timetable on filing.
