Family Lawyers in Dubai: Explaining Marriage Contracts in the UAE

By Dr. Hassan Elhais

A marriage contract should reflect the legal route available to the couple and the obligations they actually intend to undertake. Questions about dowry, financial contributions, residence and future children deserve attention before the contract is signed. A document copied from another country or another couple may not meet the applicable requirements.

Family lawyers in Dubai can help distinguish the rules for concluding a valid marriage from the additional terms spouses may agree. They can also identify arrangements that require separate property documents, court approval or advice in another jurisdiction. The central task is to make each proposed obligation clear and assess whether it can have the intended legal effect.

Identify the applicable marriage framework

Start with the parties’ nationality, religion, residence, ages and marital history. Identify the court and legal framework under which the marriage will be concluded. These facts affect the documents needed and the terms that can be included.

Federal Decree Law No. 41 of 2024 on Personal Status provides the principal federal framework relevant to Muslim marriages, subject to its scope and permitted choices of law. Eligible non Muslim couples may fall within Federal Decree Law No. 41 of 2022 on Civil Personal Status and its executive regulation. Abu Dhabi has a separate civil marriage framework.

The existence of several routes does not mean every couple can choose any of them without meeting eligibility conditions. Confirm the intended route before drafting special terms or booking the ceremony.

Check the requirements for a Muslim marriage contract

Articles 18 and 26 of the 2024 law address the elements and validity of the contract. The requirements include identification of the spouses, the absence of a prohibited relationship, the wife’s consent, an offer by the relevant guardian, acceptance by the husband and two witnesses. The legislation includes an exception concerning a Muslim wife who is not a UAE citizen where her national law does not require a marriage guardian.

The exception should be assessed and documented where relevant. It should not be assumed merely because the bride holds a foreign passport. Similarly, the availability of a relative does not establish that the person is the proper guardian under the applicable rules.

Article 41 requires court documentation in accordance with the applicable procedures, together with the required documents and medical reports. Resolve missing records and any necessary permissions before the intended signing date.

Draft special conditions within the statutory limits

Article 33 distinguishes different kinds of conditions. A condition inconsistent with the essence of marriage can affect the contract itself. Other impermissible conditions may be ineffective while the marriage remains valid. A permissible condition that does not conflict with the relevant statutory and Sharia requirements can be binding.

Couples should therefore ask what each proposed clause is intended to achieve. A discussion about work, residence or financial responsibilities may be useful, but a familiar topic does not make every formulation enforceable. The wording and intended legal consequence both require review.

Avoid a broad statement that one spouse agrees to everything the other requests. Identify the specific obligation, the circumstances in which it applies and any practical limits. Clear drafting helps the parties understand the commitment and assists later interpretation if they disagree.

Record conditions in the authenticated contract

The evidence rules in Article 33 make the formal record important. The provision links a claim for revocation to a written condition in the marriage document or acknowledgment by the spouses. Where a condition is denied, the authenticated marriage contract must contain it in writing for it to be considered.

A separate conversation, informal message or unsigned draft should not be assumed to provide the same protection. Before signing, compare the agreed draft with the version being authenticated. Ensure that both parties understand any translation and that the text accurately records the final agreement.

Keep the authenticated contract and its approved attachments together. The version held by a relative or adviser should match the official record, including any properly documented amendments.

Understand what a breach may mean

Failure to comply with a valid condition can support a request for revocation under Article 33, subject to the statutory requirements. A breach does not itself dissolve the marriage. Waiver, whether express or implicit, can affect the right to seek the remedy.

The article treats the passage of one year from knowledge of the breach as implicit consent and also addresses the effect of an irrevocable divorce. It differentiates the consideration payable depending on which spouse failed to perform the condition.

If a dispute arises, record when the breach became known and obtain advice promptly. Preserve correspondence and the official contract rather than relying on memory about when the disagreement began.

State the dowry accurately

Record the agreed dowry, identifying any immediate and deferred portions and the payment arrangements. Check that figures, currency and descriptions of any property are consistent. Retain proof of payments already made.

Articles 47 and 48 govern dowry entitlement in different circumstances, including cases where a dowry was not properly specified. Silence or an inaccurate entry should not be treated as automatically eliminating the wife’s entitlement. The consequences of separation also depend on the relevant facts and legal route.

Practical clarity matters as much as the total amount. The spouses should understand what remains outstanding and the event or arrangement governing payment, rather than leaving conflicting assumptions about whether the obligation has been discharged.

Keep ownership arrangements consistent with the contract

Article 51 recognises the independent financial estate of each spouse and restricts a husband from dealing with his wife’s property without her consent. It also recognises a claim where one spouse contributes to developing the other’s property or similar assets.

A marriage contract should be coordinated with title documents, company records and financing arrangements. If a couple intends to acquire a home together, identify the proposed registered shares and how contributions will be recorded. Do not assume that a general marriage clause automatically changes a property register or binds a lender.

Maintain evidence of substantial contributions. Transfers, invoices and written agreements can help distinguish a gift from a loan, purchase contribution or expenditure intended to be reimbursed.

Consider contractual terms under federal civil marriage law

Article 5 of the 2022 law sets the federal civil marriage age at twenty one and requires express consent before the authentication judge, the necessary disclosure and compliance with prohibited relationship rules. The executive regulation adds procedural and capacity requirements.

Article 6 allows spouses to agree terms concerning their rights during marriage and after divorce, including arrangements relating to joint custody. Financial terms should explain their scope and operation, particularly where the parties have different incomes, businesses or overseas assets.

Contractual freedom should be assessed alongside the governing law. A clause about children should not be treated as removing the court’s role in protecting their interests. Article 10 provides for judicial decisions where custody arrangements are disputed.

Distinguish the Abu Dhabi civil marriage route

Abu Dhabi Law No. 14 of 2021, as amended, operates separately. Its published statutory framework sets an age threshold of eighteen and permits agreed marriage terms. The Judicial Department also provides a procedure for authenticating civil prenuptial agreements.

The parties should confirm their eligibility and the current service requirements directly for that route. A marriage certificate issued in one jurisdiction may also require additional steps for use abroad. Obtain advice about recognition and the treatment of financial terms in any country where enforcement is likely to matter.

The Abu Dhabi Judicial Department reported 19,000 civil marriage contracts registered by its Civil Family Court in 2025, compared with 16,200 in 2024. These figures describe that court’s civil marriage service; they do not measure the use or enforceability of special marriage terms or determine a couple’s eligibility.
